This Privacy Policy explains how QuickFrame by MNTN collects, uses and discloses your personal information. This Privacy Policy governs QuickFrame’s Web site(s) at https://quickframe.com/ (“Site”) and QuickFrame services, including the use of and https://app.quickframe.com/ (collectively, the “Services”). For more information on MNTN’s collection and processing of personal information, please see the privacy policies relevant to other MNTN products or services. By using the Services, you consent to the collection and use of your personal information as outlined in this Privacy Policy. Our Collection and Use of Personal Information

While using our Service, we may collect certain personal information. Personal information does not include information that is aggregated or deidentified such that the information cannot be reasonably linked to you. When information is deidentified, we maintain it in deidentified form and do not attempt to reidentify the information. Personal information we collect about you may include:

  • Information You Choose To Submit
    • Identifiers and Account Information, such as username, email address, name, address, state, province, ZIP/postal code, city. We collect these identifiers to communicate with you, contact you with newsletters, marketing or promotional materials and other information that may be of interest to you, and provide you with news, special offers, and general information about other goods, services, and events which we offer that are similar to those that you have already purchased or enquired about unless you have opted not to receive such information.  We may also collect such information to notify you about changes to our Service, to allow you to participate in interactive features of our Services when you choose to do so, and to provide customer support. When you send messages or post content through the Services, your username, your actual name and other Personal Information may be included in the message.
    • Payment information such as credit card and similar information, if you choose to provide it. We use payment information to provide you with the Services you request. The decision to provide this information is optional. However, if you choose not to provide the requested information, you may not be able to use some or all of the features of the Services.
    • Sensitive personal information, such as your account log-in information, ethnic origin (if you choose to provide it) and the content of your messages to other users of the Services. 
  • Information We Automatically Collect
    • Internet or other electronic network activity information, such as information about your interaction with the Services and how the Service is accessed and used (“Usage Data”). To do this, we may use cookies and similar technologies (“Tracking Technologies”). This Usage Data includes information such as your computer’s Internet Protocol address (IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data. We use this information to gather analysis or valuable information so that we can improve our Services, monitor the usage of our Service, to detect, prevent and address technical issues, and to deliver customer content at customer’s direction, including to YouTube via YouTube’s API. 

In addition to the foregoing, we may use any of the above information to comply with any applicable legal obligations, to enforce any applicable terms of service, for internal business purposes such as record keeping, to provide, maintain and improve the Services and our business, and to protect or defend the Services, our rights, and the rights of our users or others.

Choices relating to Tracking Technologies

Most browsers accept cookies automatically, but you may be able to control the way in which your devices permit the use of Tracking Technologies. If you so choose, you may block or delete our cookies from your browser; however, blocking or deleting cookies may cause some of the Services, including any portal features and general functionality, to work incorrectly. In addition, while your browser settings may allow you to transmit a “Do Not Track” signal when you visit various websites, our website is not designed to respond to “Do Not Track” signals received from browsers, like many other websites. How We Disclose Your Personal Information, Including Sensitive Personal Information

We disclose your personal information with third parties for the purposes set forth in this Privacy Policy. We have not “sold” nor have we “shared” personal information, as those terms are defined in the California Consumer Privacy Act (“CCPA”) and other US state privacy laws in the preceding twelve (12) months. We collect and disclose, and in the preceding twelve (12) months collected and disclosed for a business purpose, the following categories of personal information:

  • if we believe it is necessary in order to investigate, prevent or take action regarding illegal activities, fraud, copyright violations, trademark violations or other violations of the personal or intellectual property rights of others or situations involving potential threats to the safety of any person; 
  • to our corporate affiliates, joint ventures or other companies under common control with QuickFrame (in which case we will require such entities to honor this Privacy Policy); and 
  • if QuickFrame is acquired by or merged with another entity or in connection with a sale of our assets or other business transaction. 

We do not use or disclose your sensitive personal information for purposes other than those permitted by law, including the CCPA, or with your consent. We may disclose aggregate demographic information to third parties. Any disclosure of aggregate data does not involve the disclosure of personal information nor personally identify you or any other users of the Service.

How We Retain Your Personal Information, Including Sensitive Personal Information

We will retain your personal information only for as long as is necessary for the purposes set out in this Privacy Policy. To determine the appropriate retention period, we consider the amount, nature and sensitivity of your personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements. We will retain and use your personal information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

We will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer time periods.

Transfer of Personal Information

Your information, including personal information, may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction. If you are located outside of the United States, we process and store personal information in the United States. The laws in the United States may not be as protective of your privacy as those in your location.

We will take reasonably necessary steps to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your personal information will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.

User Generated Content

Your use of areas of the Service that are intended for interaction with other users may reveal your username and may allow you to publish certain personal information about you (“User-Generated Content” or “UGC”). By choosing to use these areas, you understand and agree that anyone with access to those areas may access and forward any information about you that is contained in or that you post to those areas. Please note that we do not control who will have access to the information that you choose to make available to others, and cannot ensure that parties who have access to such information will respect your privacy or keep it secure.  We are not responsible for the privacy or security of any information that you make publicly available on the features permitting creation of UGC or what others do with information you share with them on such platforms.  We are not responsible for the accuracy, use or misuse of any UGC that you disclose or receive from third parties through the forums or email lists.

Links To Other Sites

The Services may contain links to websites operated and maintained by third parties over which we have no control. Privacy policies on such linked websites may be different from our Privacy Policy. You access such linked websites at your own risk. We encourage you to review the privacy policy of any such linked website you visit to understand that website’s collection, storage and use of your information. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators, except as disclosed on the Services.

Security

The security of your personal information is important to us. We use standard security procedures and practices appropriate to the nature of the information in an effort to protect information from unauthorized access, destruction, use, modification or disclosure. We also require our service providers to implement and maintain reasonable security procedures and practices appropriate to the nature of the information we share with them. No data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect personal information, we cannot and do not guarantee or warrant the security of any information you transmit to or from the Service, and you do so at your own risk.

If you are from Europe, QuickFrame’s legal basis for collecting and using the personal information described in this Privacy Policy depends on the personal information we collect and the specific context in which we collect it.

QuickFrame may process your personal information because:

  • We need to execute and perform a contract with you
  • You have given us permission to do so
  • The processing is in our legitimate interests and it’s not overridden by your rights
  • For payment processing purposes
  • To comply with the law

Rights Relating to your Personal Information

E-mail communications and opt-out

QuickFrame may contact you via email for the purpose of providing announcements, newsletters, promotional offers, alerts, confirmations, surveys, and/or other general communication that may be of interest to you. 

If you would like to stop receiving marketing or promotional communications via email from QuickFrame, you may opt out of such communications replying “STOP” or clicking on the UNSUBSCRIBE button or by sending us an e-mail at privacyrights@mountain.com.

Other rights relating to your personal information

Depending on where you live and subject to certain exceptions, you may have some or all of the following rights:

  • Right to Access / Know. You have the right to request that we disclose to you the personal information we collect, use, or disclose, and information about our data practices. For California residents, you may ask that we provide you with:
    • The categories of personal information we have collected about you. 
    • The categories of sources for the personal information we collected about you.
    • Our business and commercial purposes for collecting that personal information. 
    • The categories of third parties to whom we disclose that personal information.
    • The specific pieces of personal information we collected about you.
    • The categories of personal information that we disclosed for a business purpose.  
  • Right to Correct. You have the right to request that we correct inaccurate personal information that we maintain about you.
  • Right to Delete. You have the right to request that we delete personal information that we have collected from or about you. 
  • The right to object. You have the right to object to our processing of your personal information.
  • The right of restriction. You have the right to request that we restrict the processing of or refrain from processing your personal information, other than for storage purposes.
  • The right to data portability. You have the right to be provided with a copy of your personal information in a structured, machine-readable and commonly used format.
  • The right to withdraw consent. You also have the right to withdraw your consent at any time where QuickFrame relied on your consent to process your personal information.

You may exercise any of these rights by emailing privacyrights@mountain.com. We may need to collect information from you to verify your identity, such as your email address or government issued ID, before providing a substantive response to the request.

The Services also provide tools for you to correct, update or edit your personal information and control your profile. You can edit your profile and other information at any time through the Services. At any time, you can terminate your account, which will remove your profile and other personal information from view.

You may also designate an authorized agent to make these requests on your behalf. If you use an authorized agent to submit a request, please note that we may need to collect additional information, such as a valid government-issued ID, to verify your identity before processing your request to protect your information and the integrity of our Services. Where applicable, we will provide you with more information about our appeal process. When you submit a request or launch an appeal, we will limit our collection of your personal information to only what is necessary to securely fulfil your request or process your appeal. We will not require you or your authorized agent to pay a fee for the verification of your request or appeal.  Finally, you may have the right to complain to a regulator or data protection authority about our collection and use of your personal information. 

We will not discriminate against you for exercising any of these rights.

Users Under 18

Any California residents under the age of eighteen (18) who has registered to use the Services and who has posted User Generated Content on the Services can request that such information be removed from the Services by contacting us at the e-mail or address set forth above. Such request must state that they personally posted such content or information and detail where the content or information is posted. We will make reasonable good faith efforts to remove the post from prospective public view or anonymize it so the minor cannot be individually identified. This removal process cannot ensure complete or comprehensive removal. For instance, third parties may have republished the post and archived copies of it may be stored by search engines and others that we do not control.

Children’s Privacy Statement

We do not knowingly collect personally identifiable information from children under the age of thirteen (13). If we become aware that we have inadvertently received personally identifiable information from a user under the age of thirteen (13), we will delete such information from our records. Because we do not knowingly collect any personally identifiable information from children under the age of thirteen (13), we also do not knowingly distribute such information to third parties. If you are the parent or guardian of a child under thirteen (13) years of age who has provided us with their personal information, you may contact us using the above information to request that it be deleted.

Changes to This Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page. If we make material changes to the ways we use information that we collect, we will let you know via email and/or a prominent notice on our Service, prior to the change becoming effective and update the “effective date” at the top of this Privacy Policy. You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective as of the date posted on this page.
